Terms & Conditions – Colour Glitch Nintendo Switch 2 Giveaway

• Information about how to enter and the prize we are giving away forms part of these Terms & Conditions. By participating, you are deemed to accept these Terms & Conditions.
• This competition is brought to you by Boost Juice Pty Ltd (ABN 11 092 165 681) with its principal place of business at Level 8, M-City Building and Business District, 2107–2125 Dandenong Road, Clayton VIC 3168 (“Boost Juice”).
• The competition commences at 7:00am A.E.S.T. on Monday 18 August 2025 and closes at 11:59pm A.E.S.T. on Monday 1 September 2025 (“Promotional Period”).

PRIZE

• Boost Juice will give one (1) winner a Nintendo Switch 2 console (valued at approximately AUD $699 purchased by the Promoter through retail.
• The total prize pool is valued at approximately AUD $699.

WHO CAN ENTER

• Entry is open to all residents of Australia (“eligible entrants”).
• Employees of Boost Juice and its related entities, or other agencies and businesses associated with this competition (and any spouse, de-facto spouse, parent, guardian, child or sibling of those employees) are not eligible to enter this competition.

HOW TO ENTER

• To enter, eligible entrants must, during the Promotional Period:
  1. Like the competition post on Instagram at www.instagram.com/boost_juice/
  2. Follow the @boost_juice Instagram account; and
  3. Comment on the competition post sharing your IRL “glitch” moment (real life funny/awkward mishap).
  4. Multiple entries are permitted, provided each entry contains a different “glitch” moment.
  5. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram. Entrants understand they are providing their information to the Promoter and not to Instagram. Instagram membership and the use of Instagram generally are subject to the Instagram prevailing terms and conditions of use available at instagram.com. Entrants understand that they are providing their information to the Promoter and not to Instagram. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Instagram. To the extent permitted by law, each entrant agrees to indemnify, defend and forever hold harmless, Instagram and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an entrant in respect of the entrant’s participation in the promotion. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Instagram. 

HOW THE WINNER IS DETERMINED

• This is a game of skill. Chance plays no part in determining the winner.
• Entries will be judged by the Boost Juice marketing team and Alt/Shift and it’s agencies based on creativity, originality and entertainment value.
• A shortlist will be created, and final winner(s) will be approved internally before announcement.

NOTIFICATION OF THE WINNER

• The winner will be announced via Instagram on Tuesday 2 September 2025.
• Boost Juice will contact the selected winner via Instagram direct message and may continue the conversation via email to arrange prize delivery.
• If the winner does not respond within 5 working days, they will forfeit the prize and another winner may be selected.

CONSENT

• By entering this competition, the winner consents to have their personal information published in accordance with these Terms & Conditions, and agrees to participate and co-operate in all reasonable promotional activities relating to the competition. This includes (but is not limited to) being interviewed, photographed and/or filmed. The winner grants Boost Juice a free, perpetual and non-exclusive licence to use such content in all media worldwide (including online and social media) without additional compensation.

GENERAL

• The prize is not transferable, exchangeable or redeemable for cash or other prizes.
• Any ancillary costs associated with redeeming the prize are the responsibility of the winner.
• Boost Juice reserves the right to substitute a prize of equal or greater value if the advertised prize is unavailable for any reason.
• Boost Juice’s decisions in relation to all aspects of the competition are final and no correspondence will be entered into.
• Boost Juice will not be liable for any loss, damage or injury suffered in connection with the competition or the prize, except where liability cannot be excluded by law.
• Boost Juice is not responsible for technical malfunctions, lost or delayed communications, or human error that may affect the entry process.

PRIVACY NOTICE

• Personal information submitted by entrants will be used to conduct this competition, publish the winner’s details, and distribute the prize. By entering, entrants consent to their personal information being used for this purpose.
